Glasgow duty plans - Interim interdict decision

24 March 2009

A petition has been raised in the Court of Session by David Andrew O’Hagan, Philip Cohen, Gerard Sweeney, Calum Weir, Kenneth Waddell and Michael Gallen against the Scottish Legal Aid Board for judicial review of a decision taken by the Board to allocate further slots to the PDSO in the Glasgow Sheriff and District Court duty plans for 2009.

This included a motion for interim interdict to prevent the Board from implementing the 2009 plan, in so far as it purported to allocate any further slots to the PDSO from 2 April 2009 to 2 December 2009.

At the Court of Session on 24th March, Lady Stacey refused the motion for interim interdict.

The petition now goes forward for a first hearing on the 30th April.
